Mascot suspended in Brazil for obscene gestures

SAO PAULO (AP) -A team's mascot has been suspended for two home matches for making obscene gestures to opposition fans.

Ceara's "Grandpa" mascot was suspended Tuesday after making the gestures to fans from Ferroviario in a match on Sunday.

Local media reports that Ceara is also expected to punish the person who was inside the mascot costume.

Ceara was relegated from the Brazilian first division last year but is one of the most famous clubs in northeastern Brazil.

Judge: BP contract shielded Halliburton in spill (AP)

NEW ORLEANS ? A federal judge ruled Tuesday that Halliburton can avoid paying most of the pollution claims that resulted from the catastrophic 2010 Gulf of Mexico oil spill because it was shielded in a contract with well-owner BP.

Still, U.S. District Judge Carl Barbier said that Halliburton is not exempt from paying punitive damages and civil penalties that arise from the April 20, 2010, blowout off the Louisiana coast. Those penalties could amount to billions of dollars.

The judge also said Halliburton's indemnity could be voided if the company is found to have defrauded BP. He did not rule on BP's allegations that Halliburton committed fraud by declaring the cement safe to use.

Houston-based Halliburton supplied cement for the ill-fated Macondo well that blew out in the Gulf of Mexico, and federal investigators have found that the cement failed to seal to the well properly. The cement job was one of several factors that investigators said contributed to the blowout that killed 11 workers and led to the release of more than 200 million gallons of oil.

In court filings, BP has accused Halliburton of hiding information about cement tests and defrauding BP by telling the company that the cement was safe to use. Halliburton has said it did not conceal information or commit fraud.

Both sides claimed victory on Tuesday.

BP touted Barbier's ruling as a "strong signal" that Transocean and Halliburton "would be held accountable."

"These two decisions should put an end to the attempts by Transocean and Halliburton to avoid their obligations," BP said. The company added that Halliburton "at a minimum" faced paying punitive damages and civil penalties for its role in the disaster.

BP also said it "never assumed" to get Transocean and Halliburton to pay for pollution-related damages.

Beverly Blohm Stafford, a Halliburton spokeswoman, said the company agreed with the ruling "to the extent that it requires BP to honor its contractual indemnity obligations."

Barbier's ruling came in advance of a Feb. 27 non-jury maritime-law trial in New Orleans to determine who was at fault for the blowout that led to the nation's largest offshore oil spill. Transocean, BP and Halliburton have been sparring over what caused the blowout.

Last week, BP asked U.S. Magistrate Sally Shushan to exclude trial testimony by a Halliburton employee who was working on the rig before the explosion and has been identified as a possible subject of a Justice Department criminal investigation of the disaster.

Jesse Gagliano, who worked on the well's cementing job, has been interviewed by a congressional committee and testified before a government panel probing the disaster. He initially invoked his Fifth Amendment right against self-incrimination and refused to be questioned under oath for the litigation, but he recently waived that right and agreed to be questioned by civil attorneys next week.

BP suggests Gagliano's change of heart so close to the trial is designed to give Halliburton a strategic advantage. Halliburton counters that "unfounded speculation" about Gagliano's motives shouldn't preclude his testimony.

Review: Super Bowl online decent, but is not TV

NEW YORK?? The television set won't be the only place to watch video of the New York Giants and the New England Patriots this Sunday. For the first time, U.S. football fans will be able to watch the Super Bowl live on a computer or on a phone.

You may be wondering whether anyone without super-strength eyesight would be able to follow the football on a tiny phone screen. And what about the ads? After all, many people tune in more for the commercials than for the game.

I got a chance to test the offering with a pair of playoff games and last weekend's all-star Pro Bowl. Although it's impossible to say what will happen Sunday, I have found the experience decent so far, but no substitute for the big screen.

The phone offering is made possible through a collaboration involving the National Football League, Comcast Corp.'s NBC and Verizon Wireless.

The nation's largest wireless carrier had rights to carry NBC's Sunday night broadcasts live during the regular season, as well as some games from the NFL Network and ESPN. The post-season games broadcast by NBC are an extension of that package.

That means you'll need service through Verizon Wireless to watch on an iPhone or an Android phone. Unless you have the higher-speed 4G service through Verizon, you'll also need its V Cast video service, which costs $3 a day or $10 a month on top of your regular phone bill. A generous data plan or a Wi-Fi connection will help you avoid additional charges.

If you don't have the right phone or wireless carrier, or if you have a super-cheap data plan with low caps, you can watch for free on a computer instead at NBCSports.com.

You can interact with the game more that way, but you won't get the same commercials.

To get started on the phone, you need to install the NFL Mobile software. The app is free; it's the software's live video that requires V Cast. You can get the app on the phone through the Android Market or Apple's app store. Or you can go to http://www.verizonwireless.com/nfl and enter your cellphone number. A text message will be sent with a link to get your app. You can also call the NFL by hitting the star key twice and dialing 635. That will also get you a link via text.

The video is easy to find once you open the app.

You get the full NBC broadcast, including replays, announcers and on-screen graphics. You also get the halftime show and national commercials. NBC's peacock logo came up when my local NBC station was showing ads for local merchants such as car dealers and banks.

As for the football, I was surprised how well I was able to follow it. I wasn't able to track the ball for some of the passes and field goal kicks, but I was able to follow it on runs. Sure, the ball is small, but your eyes are much closer to the screen. So proportionally, it's somewhat comparable to what you'd get standing several feet away from the TV.

The video quality was adequate over a cellular connection. Some of the players looked more like video game characters than real people, reminding me of the early days of Internet video. Quality improved with a Wi-Fi connection because more data can be sent without worrying about congestion or data charges.

Video on the phone lagged the TV broadcast by about 30 seconds, so don't fall for any instant bets your TV-watching friends try to make with you. If others are watching in the next room, be prepared for cheers and jeers before you see the action.

Also, for the first half-hour, the app will ask you a few times whether you are really there. The video stops if you don't confirm your presence. I found it disruptive, though Verizon says it's to ensure that people don't inadvertently run up data charges.

And if you were able to snag tickets to the Super Bowl, don't expect to watch the game on the phone. Verizon will block the video in and around the stadium to avoid overrunning its network. Besides, if you made all that effort to be there in person, you should be watching the field, not your phone.

The experience on the computer is different. Online video lagged the TV broadcast by a full minute ? enough for an interception and touchdown.

As was the case with the playoffs and the Pro Bowl, online video ads will replace the ones shown on TV. However, NBC says it will make the television ads available on demand soon after they run, so you won't have to miss out on all the chatter about the best and worst Super Bowl commercials. It's also a place to go if you missed one on TV. The phone won't have commercials on demand.

Other extras on NBC's video player include multiple viewing angles. Besides the main television feed, you can watch from the end zone or the sideline or a camera that locks in on the "star" ? typically whoever has the ball. You can watch two feeds at once ? one in a smaller window within the larger one. You can also get Twitter updates, players' stats and more.

The Web player also lets you pause, rewind or start from the beginning, just like a digital video recorder. With the mobile app, you're stuck with the live feed.

And with a good broadband connection, you don't have to worry about data charges.

One of the games I tested over a cellular connection used up 425 megabytes of data, including the halftime show. Fortunately, I was able to keep an unlimited plan I had before Verizon started capping usage for new subscribers. If you're on the basic, $30-a-month plan, one game will eat up a quarter of your monthly 2 gigabyte allocation. There's not much left for email, YouTube, Facebook and other mobile time sinks.

One other thing to note: Verizon's live video won't be available on iPads. Owners of Apple's tablet computer will have to visit NBC Sports' website on a browser.

Hardcore football fans might be thinking: "Why would anyone want to watch the big game on a phone or a computer screen?"

I agree there's no replacing the experience on a thousand-inch flat screen, with a bowl of chips and other artery-cloggers within reach.

But I can think of a few scenarios where it could be useful. If you're en route to a Super Bowl party, you can have the game on in the car or bus (not if you're driving, please). You can follow along on your device as you walk to the door for your pizza delivery.

Or if you're with friends who couldn't care less about the game, you can have it on and still be with them ? physically, at least.

Megaupload users: EFF wants to help you recover lost files (Digital Trends)

As of Monday, it seemed all but guaranteed that the files stored on the servers used by Megaupload, which was seized by the US government on January 19, were gone for good. This includes the data of people who used Megaupload for legitimate purposes, like distributing work documents, or their own photo and video creations. But thanks to a collaborative effort between the Electronic Frontier Foundation (EFF) and Carpathia Hosting, which owns and operates many of the servers used by Mega in the US, users who lost their files may now have a way to get them back.

The EFF is now offering its legal services to ?innocent? Megaupload users who lost access to their files. While the online rights organization does not guarantee that it can successfully help recover users? data, it has asked users to email with details about their situation, which will be used to help the case for gaining access to the data.

?EFF is troubled that so many lawful users of Megaupload.com had their property taken from them without warning and that the government has taken no steps to help them,? said Julie Samuels, Staff Attorney at EFF, in a statement (pdf). ?We think it?s important that these users have their voices heard as this process moves forward.?

At present, Carpathia ?does not have access to any data for Megaupload customers,? said Brian Winter, CMO of Carpathia Hosting, in a statement. But he added that Carpathia supports ?the EFF and their efforts to help those users that stored legitimate, non-infringing files with Megaupload retrieve their data.? To backup their claims of support, Carpathia has launched MegaRetrieval.com, which provides contact information and further details about the EFF?s efforts to help users recover their files.

No charges for airmen who posed around casket

The Air Force has concluded there was ?no criminal conduct? by airmen who posed around an open casket with another airman inside pretending to be dead.

The photo, which first came to light on Dec. 13 in the Air Force Times, drew outrage from military commanders, military wives, widows and others who saw it as mocking deceased service members.

Rather than criminal charges, the airmen involved in the picture received administrative punishment because their conduct ?brought discredit to both the military and themselves,? Col. Gregory Reese, commander of the 37^th Training Group, said in news release sent to msnbc.com. The Air Force said it does not disclose details of administrative actions due to privacy concerns.

??The investigation indicated that the photo was intended by those who took it to remind the students that they could be killed if they failed to pay attention while loading and unloading aircraft,? Reese said.

The service members in the picture were airmen with the 345th Training Squadron at Fort Lee, Va., where they learn to load and unload aircraft. Their unit is a detachment from a command at Lackland Air Force Base in San Antonio, Texas, which issued the news release about the punishment.

The photo, it turned out, was a sort of unofficial class picture in which ?creativity got ahead of common sense,? Gerry Proctor, 37^thTraining Wing spokesman, told msnbc.com.

After the photo became public, Air Force Secretary Michael Donley, expressed concern that the photo might cause more turmoil for families of fallen troops.

"Such behavior is not consistent with our core values, and it is not representative of the Airmen I know. It saddens me that this may cause additional grief to the families of our fallen warriors,? Donley told? the Air Force Times.

In response to the photo, 37th Training Wing commander, Col. Eric Axelbank issued a wing-wide policy that requires all class photography and memorabilia?to be?reviewed by squadron commanders.

Proctor told msnbc.com that with the investigation complete and administrative punishment handed out, the Air Force considers the case closed.
